“We are two recently retired UVM professors who have studied the criminal legal system. Based on our work, we strongly support Sarah George for State's Attorney and want to explain why.
The central issues in the Chittenden County State's Attorney race focus on whether cash bail improves accountability and public safety, and if restorative justice makes communities safer.
Sarah George's office no longer seeks cash bail for pretrial release because, she argues, it penalizes individuals based on wealth rather than risk of flight or threat to public safety. Her opponent, Bram Kranichfeld, advocates expanding cash bail to reduce crime.
Because many are unfamiliar with how cash bail operates, here are key facts:
It is the money an arrested person pays a court to secure release while awaiting trial.
Its sole legal purpose is to ensure the defendant returns to court.
Only judges set bail; prosecutors can only recommend it.
If someone cannot afford it, they remain jailed until trial, regardless of community danger.
Nationwide, about 75% of people in local jails are legally innocent and awaiting trial, often simply because they cannot afford bail.
Cash bail creates deep inequity. Wealthy people await trial at home, while poorer folks facing similar charges remain incarcerated. Declining cash bail for lower-level offenses reduces this disparity.
Jail also brings severe collateral consequences. Even brief jail stays cause people to lose jobs, housing, family stability, and child custody, increasing future offending driven by economic hardship. Keeping people connected to their communities while awaiting trial is both more humane and effective. It is also fiscally responsible. Vermont spends over $100,000 annually to incarcerate one person—among the highest costs nationally. Extensive research shows incarceration increases recidivism because jails are designed for detention and punishment, not rehabilitation.
The key question is whether eliminating cash bail increases missed court dates or crime. Numerous jurisdictions—including New Jersey, Washington, D.C., Santa Clara County, Cook County, Harris County (TX), and Kentucky—have reduced or eliminated cash bail. Research consistently shows this doesn't increase failure-to-appear rates or reduce public safety.
Chittenden County faces real challenges with crime. People are understandably frustrated. Repeat shoplifting has received particular attention. Some wonder why shoplifters appear back on the street the next day, assuming the State's Attorney declined to prosecute. In reality, after police issue a citation, it typically takes 4 to 6 weeks for paperwork to reach the State's Attorney's office before charges can be filed.
Research shows that addressing the root causes of crime—including poverty, housing insecurity, addiction, mental illness, and economic instability—is far more effective than relying on cash bail.
However, long-term solutions, which must come from the state and municipalities, do not immediately address repeat low-level offenses. The origins of the current crisis date to COVID-19, which resulted in the courts shutting down and backlogs of cases. Sarah George opted to prioritize prosecution of more serious crimes.
More recently, she requested resources from Governor Scott to establish an "accountability court." This specialized docket accelerated case processing; of approximately 1,100 backlogged cases, roughly 900 have now been resolved.
Sarah George continues the accountability court. Crucially, the Howard Center participates, helping connect defendants with housing, treatment, and services. This model is now expanding to other Vermont counties, including those that continue to use cash bail.
Sarah George was also an early supporter of restorative justice, now used throughout Vermont. Data show that restorative justice programs—which require offenders to acknowledge and repair the harm they caused—reduce reoffending while giving victims a meaningful voice. These programs are especially effective with juveniles, reducing reoffending by as much as 44 percent.
While Sarah George uses diversion for some lower-level offenses, she vigorously prosecutes serious violent crimes. For example, in the Ferlazzo murder case, her office requested a sentence of 50 years to life; the judge opted for a shorter sentence.
Ultimately, the strongest public safety strategies are those supported by research—approaches that reduce recidivism, address the root causes of crime, promote accountability, and use taxpayer dollars wisely. Sarah George follows guidance that is documented by research.
